Through Auto 181 the 27 March 2012, Regional Autonomous Corporation of La Guajira, formulated a statement of charges against the Municipality of Riohacha for the presence of a satellite solid waste dump, without compliance with the requirements established in environmental standards, located on the road that leads from Riohacha to Valledupar (Kilometer 2), which violates the Resolutions 1045 of 2003 and 1390 of 2005, issued by the Ministry of Environment, Housing and Territorial Development and the Decree 838 the 23 March 2005.

The opening of this environmental investigation began with Auto No. 093 the 27 February 2012, after officials from the Control and Monitoring Group of this entity detected several anomalies, among them the inadequate disposal of solid waste scattered throughout approximately two hectares. Because of this, The highest environmental authority exhausted the persuasive stage, requiring the Municipality of Riohacha that within the term of 30 days will begin the pertinent actions to eradicate the dump, However, in a new follow-up visit it was found that the situation remained in the same conditions..

Corpoguajira granted the Municipality a period of ten business days to present its defenses and provide or request the taking of evidence that it considers relevant and that is conducive to this process..
