The highest environmental authority fined $887.604.876, because INCODER not carried out the removal of the vegetation cover of the dam El Cercado.

Through Resolution 1750 the 12 October 2011, Corpoguajira hill with research adminsitrativa – environment against the Colombian Institute for Rural Development – INCODER- and declared it responsible entity did not carry, or executed the activity set out in the Environmental Management Plan, in connection with the filling of the reservoir, by not complying with the technical and environmental criteria to be applied in the development of forest management activities, clearing and stripping of vegetation cover. As part of the penalty, INCODER, shall pay a fine of $887.604.876.

"For us as environmental authority, the activity violates the legal guidelines, since not comply with the implementation of the Environmental Management Plan, regarding the removal of vegetation cover, INCODER, violates the provisions of the plan, putting at risk the environment and ignores the obligations established by the Corporation ", Manifesto Arcesio Romero Perez, General Manager Corpoguajira.

In recent months, this Corporation received several complaints from residents of the village of Caracolí (San Juan del Cesar), who showed possible contamination of water from the dam, due to the death of animal and crop; as was apparent with the visit to the site of interest, Corpoguajira by officials who conclude to perform the work relevant to the removal of biomass that currently is under water.

As part of the investigation, INCODER argues that in the second half of 2010, the area where the dam is located El Cercado, was influenced by the phenomenon of "La Niña", which caused premature filling of the reservoir. Faced with this situation, Corpoguajira always made the necessary recommendations on the removal of vegetation cover, to handle this event in different environmental monitoring visits, which were not considered by him fined undertaking.

Also as a precautionary measure for La Niña, Corpoguajira solicit INCODER a contingency plan that would address various aspects, which was not carried out.
