In order to start the implementation of environmental subpoena, Regional Autonomous Corporation of La Guajira, socialized today a pilot project that aims to have a group of eco patrols in support of the environmental authorities, to punish people, undertakings and entities who violate the provisions of Law 1259 December 19 of 2008 and the decree 3695 of 2009, issued by the Government.
The purpose of this initiative is to provide services groups trained in handling, care and maintenance of environmental issues as the control for improper disposal of solid waste (Decree 1713/02), liquid discharges, noise pollution, illegal possession of species, damage to flora, open burning, pruning, logging of flora located in areas of public access, inter alia.
"The environmental subpoena, will function as an instrument of civic culture, about the proper management of solid waste and debris, anticipating the effects on the environment and public health, through educational and economic sanctions to all those natural or legal persons violating existing regulations in this area ", Romero Perez explains Arcesio, General Manager Corpoguajira.
The penalties to be imposed, include environmental education workshops offenders, providing social service days and fines up to two monthly minimum wages, for each violation. In the case of legal persons fines can be up to twenty monthly minimum wages. In relation to commercial establishments, buildings or factories, where breaches of hygiene regulations accrues and debris management, the violation of the law may result in the suspension or cancellation of registration or license
They are offenses against the standards of grooming, the following:
1. Take out the trash at times not authorized by the company providing the service.
2. Do not use containers or other items ready to throw garbage there.
3. Having trash and debris in public places not agreed or approved, such as: corners, traffic lights off, mobile boxes, sewer grates, hydrants, bus stops, zebras for the passage of pedestrians, in pedestrian bridges, with trees and communal scales.
4. Trash and debris accumulate on the walls of schools, health centers, food establishments, drug stores and shopping centers.
5. Uncover and remove, partially or fully, without authorization, the contents of the bags and containers for trash, once placed for collection.
6. Improperly dispose dead animals, parts thereof and biowaste, like common trash, or in public places.
7. Hamper, somehow, activity sweeping and collection of garbage and debris.
8. Storing waste materials and construction or demolition roads and public areas.
9. Burning trash and debris, without adequate security measures, in sites not authorized by the competent authority.
10. Improvise and install without legal authorization, containers or other containers, destined for the garbage disposal.
11. Washing and cleaning out any object in roads and public areas, these activities causing garbage accumulation or entertainment.
12. Allow the deposition of feces of livestock and other animals and grassland sites are not suitable for this purpose, and without any control.
13. Send mismanagement at sites where it is classified, markets, recycled or processed solid waste.
14. Encourage fret trash and debris unfit or adequate means, to places where it is forbidden to deposit.
15. Littering from a motor vehicle in motion or static public roads, parks or public areas.
16. Industrial waste.
Pilots municipalities that begin implementing environmental subpoena are Riohacha, San Juan del Cesar and Maicao.
