Within the framework of this process, the Department of La Guajira, did not provide evidence, nor did he request the practice of these, reason why the highest environmental authority proceeded to close the environmental investigation and impose the sanction on the Departmental Administration, with a fine of $163.382.746.
Article 58 decree 1791 of 1996 establishes that when felling is required, transplant or relocate isolated trees located in urban centers, for the realization, remodeling or expansion of public or private infrastructure works, buildings, facilities and similar, Authorization will be requested from the respective Corporation, before the environmental authorities of large urban centers or before the municipal authorities, depending on the case, which will process the request, prior visit carried out by a competent official, who will verify the need for felling or relocation alleged by the interested party, for which it will issue a technical concept.
Against the administrative act issued by Corpoguajira, the appeal for reconsideration proceeds, which may be filed within five business days following its notification, The Resolution was notified by edict, unfixed the day 20 de Junio de 2012 to the Departmental Administration.
